Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Alanas Kalinauskas, an individual trading as "aicontent.beauty" and "The AI Creator System" ("we", "us", "our"). By purchasing, accessing, or using our website, products, prompt packs, downloads, or any related materials (together, the "Product"), you agree to be bound by these Terms. If you do not agree, do not purchase or use the Product.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to purchase or use the Product. By buying, you represent and warrant that you meet these requirements and that all information you provide is accurate.

2. License

Subject to your payment and continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Product for your own individual, non-commercial educational purposes only.

You may not, in whole or in part: resell, sublicense, rent, lend, share, distribute, publish, post, upload, broadcast, or make the Product available to any other person; grant access to your login or files; reproduce or create derivative works for distribution; or use the Product to build, train, or populate any competing product, dataset, course, or service. The Product is licensed, not sold, and no ownership passes to you.

3. Intellectual Property

All content, text, prompts, images, videos, workflows, templates, and materials in the Product are owned by us or our licensors and are protected by copyright, trademark, and other laws. All rights not expressly granted are reserved. Any unauthorized use immediately terminates your license without refund and may result in legal action, for which you agree to be liable for our damages, costs, and reasonable attorneys' fees.

4. Educational Purpose Only - No Advice

The Product is provided for general informational and educational purposes only. It does not constitute, and must not be relied upon as, financial, investment, legal, tax, business, or professional advice. You are solely responsible for your own decisions and for obtaining independent professional advice where appropriate.

5. No Guarantee of Results - Earnings Disclaimer

We make no representation, warranty, or guarantee of any kind that you will earn any money, achieve any result, gain any followers, or avoid any loss. Any figures, screenshots, case studies, or examples are illustrative, are not typical, and are not a promise or projection of your results. Your outcomes depend on factors we do not control, including your effort, skill, market conditions, and the policies of third-party platforms. You accept full responsibility for any risk, loss, or expense you incur.

6. Third-Party Tools and Platforms

The Product references and may link to third-party tools, software, and platforms (including, without limitation, AI generation tools and social media platforms). Some links are affiliate links from which we may earn a commission at no extra cost to you. We do not control and are not responsible for third parties, their availability, pricing, terms, or actions (including account suspension or bans). Your use of any third party is at your own risk and subject to their terms. You are solely responsible for complying with the terms, rules, and applicable laws of every platform you use, including any content-disclosure or AI-labeling requirements.

7. Acceptable Use

You agree not to use the Product for any unlawful, deceptive, harassing, infringing, or harmful purpose, and not to create content that is illegal or that violates the rights of others. You are fully and solely responsible for any content you create and any consequences arising from your activities.

8. Payment, Prices and Taxes

Payments are processed by our third-party payment provider. You authorize us and our provider to charge your selected payment method for the total amount, including any applicable taxes. Prices, offers, and bonuses may change at any time without notice; the price displayed at checkout applies to your purchase. You are responsible for any taxes, duties, or fees imposed by your jurisdiction.

9. Refunds

Except for the limited, conditional guarantee described in our Refund Policy, all sales are final and payments are non-refundable to the maximum extent permitted by law. The Refund Policy is incorporated into these Terms.

10. Disclaimer of Warranties

THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED, ERROR-FREE, CURRENT, OR THAT ANY CONTENT, METHOD, PROMPT, OR SETTING WILL WORK, REMAIN AVAILABLE, OR PRODUCE ANY OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ACCOUNTS, OR OPPORTUNITY, HOWEVER CAUSED. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE PRODUCT IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE SMALLEST AMOUNT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold us and our affiliates, officers, and agents harmless from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Product, your content, your breach of these Terms, or your violation of any law or third-party right.

13. Chargebacks

If you have a billing concern, you must contact us first at hello@aicontent.beauty. Initiating a chargeback, payment dispute, or reversal without first requesting a refund in accordance with our Refund Policy is a breach of these Terms. We reserve the right to immediately and permanently revoke your access and license, to refuse future purchases, and to submit these Terms, your acceptance, your access logs, and delivery records as evidence in any dispute.

14. Termination

We may suspend or terminate your access and license at any time, with or without notice, if you breach these Terms or if we reasonably suspect fraud, abuse, or unauthorized sharing. Upon termination you must stop using and delete all copies of the Product. Sections that by their nature should survive (including licensing restrictions, IP, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.

15. Changes

We may modify the Product or these Terms at any time. Updated Terms are effective when posted with a new "Last updated" date. Your continued use after changes constitutes acceptance.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law rules. Any dispute will be resolved exclusively by final and binding individual arbitration or in the courts located in the Republic of Lithuania, and you consent to that venue. To the fullest extent permitted by law, you waive any right to participate in a class, collective, or representative action, and disputes must be brought in your individual capacity only. Any claim must be brought within one (1) year after it arises or it is permanently barred.

17. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may. These Terms, together with the Refund Policy and Privacy Policy, are the entire agreement between you and us and supersede all prior understandings.
